Description

The Fidelity Institutional Legal Group is responsible for providing advice on all legal aspects and issues within the businesses that constitute the Fidelity Institutional group (National Financial, Institutional Wealth Services, Family Office and Capital Markets) within the Fidelity Personal, Workplace and Institutional Services group, including advice on laws, rules and regulations, new product development or product enhancements, contract negotiations, as well as policies and procedures.

As part of Fidelity's Corporate Legal group, you will provide advice to and work closely with internal clients within Fidelity Institutional in areas such as Operations, Risk, Sales, Relationship Management and Compliance.

Position Responsibilities

* Provide superior and experienced senior legal support and advice to the Institutional Wealth Services group ("IWS") and Family Office Services group ("FOS") on complex matters pertaining to laws, regulations and requirements regarding retirement products, services and policies, with a detailed and primary focus on ERISA, IRC, trust and fiduciary requirements.

* Draft and negotiate client agreements with trust/banks and third party administrators.

* Perform legal research, interpret and advise IWS/FOS on legal and regulatory developments and requirements regarding retirement matters, including review and interpretation of state laws with regard to specific trust fiduciary issues.

* Partner with IWS/FOS and Fidelity Personal Trust Company product, risk, compliance, finance, sales, technology and marketing representatives to develop new products and services for distribution to clients, to grow the business, provide innovative solutions to business opportunities through the application of applicable related regulatory and legal requirements while working to mitigate risk.

* With minimal supervision, provide superior senior legal support and project management in connection with complex products and initiatives.

* Review and recommend appropriate policies and procedures to comply with laws and regulations to facilitate ongoing compliance with retirement, trust and fiduciary rules and requirements.

* Coordinate, oversee and manage engagement of outside counsel on product offerings and related matters.

* Persuasively advocate for and effectively represent IWS and FOS and their positions to third parties including regulators.

* Perform Coordinate and significantly participate in cross functional or cross company initiatives.

* Collaborate with and influence senior business management to identify optimal solutions for business objectives in compliance with legal and regulatory requirements while managing risk.

* Manage, mentor and develop less experienced attorneys and non-attorneys.

* Must be able to confidently and expertly manage direct interactions with IWS and FOS senior management in a professional manner; exercise superior judgment and expertly advocate for IWS and FOS in complex and difficult situations.

* Must be comfortable working autonomously.

Qualifications

Education and Experience


* J.D. required. Membership in the Massachusetts Bar.

* Minimum of 5-8 years of relevant law firm or equivalent experience in retirement, trust and fiduciary law.

* Broker dealer and/or investment advisor experience a plus

* Highly effective presentation, advocacy, oral communication, negotiation and interpersonal skills, including client relationships skills and the ability to influence diverse business groups, including senior business leaders on high profile matters

* Innovative and strategic thinker, excellent judgment, ability to partner with the business, risk, compliance and operations groups to assist in growing the business while managing risk

* Strong analytical, investigatory and process skills - need to be able to quickly analyze complex factual situations or transactions to understand key legal, risk and operational processing issues.

* Strong client relationship skills and ability to independently influence senior business leaders

* Superior writing and research skills, adaptive to and effective for different audiences; strong and skilled computer and technology user

* Experience drafting and negotiating contracts

* Ability to work independently and under pressure and handle multiple competing complex tasks simultaneously to closure; strong work ethic.

* Develop and manage relationships with senior business management with respect to strategic issues.
